Terms of Service

These Terms of Service govern your access to and use of Mana, a creator intelligence and discovery platform operated by GTM Labs SL (“Mana,” “we,” “us,” or “our”).

By accessing or using Mana, you agree to these Terms.

1. The Mana service

Mana helps businesses discover, organise, analyse, and evaluate creators and their publicly available content.

The service may provide:

• Creator profiles and public social-media information

• Content categories, subcategories, and topics

• Performance and activity metrics

• Creator-to-brand affinity assessments

• Campaign research and planning tools

• Automated classifications and AI-generated analysis

Features may change or be updated over time.

2. Eligibility and accounts

Mana is intended for businesses and professional users.

You are responsible for:

• Providing accurate account information

• Keeping your login credentials secure

• All activity performed through your account

• Ensuring that authorised users comply with these Terms

• Notifying us of suspected unauthorised access

You may not share access outside your organisation unless permitted by your subscription or agreement with Mana.

3. Acceptable use

You may use Mana only for lawful business purposes.

You must not:

• Use Mana to harass, threaten, discriminate against, or unlawfully surveil individuals

• Use the service for illegal or fraudulent activities

• Attempt to access another customer’s account or data

• Interfere with the security or operation of the service

• Reverse engineer or attempt to extract Mana’s source code, models, or proprietary systems

• Resell, reproduce, or redistribute substantial parts of Mana’s database or analysis without written permission

• Use automated methods to access Mana except through an authorised API or integration

• Present Mana’s classifications or scores as official statements from a social platform

• Use information obtained through Mana in violation of applicable laws or third-party rights

We may suspend or terminate access where we reasonably believe these requirements have been violated.

4. Social platforms and third-party services

Mana may process public information from YouTube, Instagram, TikTok, and other social or online platforms.

Your use of platform-related features may also be subject to the terms and policies of the relevant platform. You are responsible for complying with those requirements when using information obtained through Mana.

Mana is an independent service and is not owned, operated, sponsored, or endorsed by YouTube, Google, Meta, Instagram, TikTok, or any other social platform unless expressly stated otherwise.

Mana uses YouTube API Services.

By using functionality that incorporates YouTube API Services, you also agree to be bound by the YouTube Terms of Service.

YouTube and Google may change, restrict, or discontinue their services independently of Mana. We are not responsible for changes to the availability or functionality of YouTube API Services.

5. Creator information and automated analysis

Mana processes publicly available creator and content information and uses proprietary systems to generate classifications, metrics, scores, and recommendations.

These results:

• Are estimates based on the information available at the time

• May be incomplete or inaccurate

• May change when source information, taxonomies, or models change

• Are not official classifications or endorsements from any social platform

• Do not guarantee the suitability, availability, performance, or conduct of a creator

You are responsible for reviewing the available information and carrying out your own due diligence before contacting, selecting, contracting, or paying a creator.

Mana does not act as an agent for creators and does not guarantee that a creator will respond to or accept a collaboration.

6. Customer data

You retain ownership of information that you submit to Mana.

You grant us permission to process that information only as necessary to:

• Provide the service

• Operate requested integrations

• Maintain security

• Provide support

• Comply with legal obligations

• Improve the service where permitted by our agreement with you

You are responsible for ensuring that you have the right to submit and process any information you provide to Mana.

Our processing of personal information is described in our Privacy Policy.

7. Intellectual property

Mana, including its software, interface, taxonomy structure, models, classifications, scoring methods, documentation, and branding, is owned by or licensed to GTM Labs SL.

These Terms do not transfer ownership of Mana’s intellectual property to you.

Subject to your subscription and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to use Mana for your internal business purposes.

Third-party content and platform data remain subject to the rights and terms of their respective owners.

8. Service availability

We aim to provide a reliable service, but we do not guarantee that Mana will always be available, uninterrupted, secure, or error-free.

Features may be affected by:

• Maintenance

• Technical failures

• Changes made by social platforms

• Third-party service interruptions

• API restrictions or quota limits

• Events outside our reasonable control

We may modify or discontinue features where reasonably necessary.

9. Disclaimer

Mana is provided on an “as available” basis.

To the maximum extent permitted by law, we do not guarantee:

• The accuracy or completeness of creator information

• The accuracy of automated classifications or scores

• Specific campaign or commercial results

• That a creator is suitable for a particular collaboration

• Continued access to information from third-party platforms

Mana provides decision-support tools and does not provide legal, financial, or professional advice.

10. Limitation of liability

To the maximum extent permitted by applicable law, GTM Labs SL will not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from the use of Mana.

Our total liability relating to the service will not exceed the amount paid by the customer to Mana during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

11. Suspension and termination

You may stop using Mana at any time.

We may suspend or terminate access if:

• You breach these Terms

• Payment obligations remain outstanding

• Your use creates a security or legal risk

• We are required to do so by law or a third-party platform

• Continuing to provide the service is no longer reasonably possible

Sections that by their nature should continue after termination will remain effective.

12. Changes to these Terms

We may update these Terms to reflect changes to Mana, applicable law, or third-party platform requirements.

The updated version will be published with a revised “Last updated” date. Continued use after an update constitutes acceptance of the revised Terms where permitted by law.

13. Governing law

These Terms are governed by the laws of Spain.

Unless mandatory law provides otherwise, disputes relating to these Terms or Mana will be subject to the courts of Madrid, Spain.
